In this article (in Dutch), Marc de Vries advocates that the implementation of the PSI Directive should not be done within the framework of the Dutch Freedom of Information Act (de Wet openbaarheid van bestuur), but as a separate law where it will have its place in the context of competition law.
Meanwhile, unfortunately, the implementation has taken place within the FOIA, however, there are now plans to redraft the full legal framework on PSI, not only related to re-use, but covering the entire life cycle of PSI, bundling rules on (a) access (b) accessibility (c) re-use (d) exchange of PSI between public sector bodies (e) rights of persons in relation to personal information held by public sector bodies, and (e) archiving of PSI.
